FilePoppy Terms of Service

The agreement, in plain English.

Effective September 4, 2026. These terms are an agreement between you and PeopleStar Enterprises, Inc. ("PeopleStar", "we"), the maker of FilePoppy™. Using FilePoppy means you accept them. If you do not, please do not use it - and write to us if something here is the reason why.

1. Who may use FilePoppy

FilePoppy is built for licensed real estate professionals - agents, brokers, and the transaction coordinators who work with them. The first time you sign in we ask for your real estate license number and state, and a person on our team checks it, usually the same business day. Until it is verified the product screens stay closed. You must be at least 18 and able to enter a binding agreement.

2. Your account

You sign in with a six-digit code emailed to you, or with Poppy ID, the shared sign-in for the Poppy apps at officepoppy.com. Anyone who can read your email can sign in as you, so keep that mailbox secure. You are responsible for what happens under your account. Tell us at once if you believe someone else is using it.

3. Plans, trial, and payment

  • Agent - $19 a month, or $190 a year. Packages up to four transactions a month. A transaction is one deal's Communication Package in a month; rebuilding a deal you have already packaged is always free and never counts twice.
  • Signature - $39 a month, or $390 a year. Unlimited transactions, and your brand kit on the package cover and the log.
  • Executive - $29 per seat per month, or $290 per seat per year, with a three-seat minimum. Set up through officepoppy.com/executive.

Every plan begins with a 14-day free trial. A card is required to start the trial, and nothing is charged until the trial ends. Checkout is handled by Stripe; FilePoppy never sees your card number. Annual is exactly ten times monthly: pay for ten months, get twelve. Prices are in US dollars and may change; a change to your price will be told to you before it applies, and never in the middle of a period you have already paid for.

4. Cancelling

Cancel anytime, two ways, whichever you prefer. In the app, open Settings and use Manage billing, which is your own billing page at Stripe: cancel there, change your card there, and read every invoice there. Or write to us at Chip@chipandkim.com from the email your account is under, and we will do it for you and confirm by email. Your plan then runs to the end of the period you have paid for and does not renew. Cancelling during the trial means you are never charged. Your transactions stay in your account after cancelling so that you can still read them and download what you have; building new packages needs a plan.

5. What FilePoppy is, and what it is not

FilePoppy produces a record: the texts, emails, photos and recordings of a transaction, gathered as they happened, attributed, dated, and fingerprinted so that a change can be detected. That is the whole of what it does.

FilePoppy is not legal advice and makes no compliance determination. The Communication Package is never a compliance judgment. It does not decide whether a record is complete enough, whether a disclosure was made, whether a deadline was met, or whether anything in it satisfies any law, regulation, or brokerage policy. Those questions belong to you, your broker, and your attorney.

Features described as planned or in development - such as a compliance checklist or a Brokermint- and SkySlope-ready folder - are not part of the service until they ship, and no plan is sold on the promise of them.

6. Text messages need a Mac

Apple allows only a Mac to read the Messages database. FilePoppy's text-message capture therefore requires a Mac signed into the same Messages account as your iPhone, with FilePoppy Capture installed and granted Full Disk Access by you. Without a Mac, emails, photos, recordings and the package all still work; texts do not flow in on their own. The Messages database never leaves your Mac; only the conversations you tick are sent.

7. Your record is your responsibility

You decide what goes on the record - which conversations you tick, which emails you forward, which recordings you add. You are responsible for that content and for having the right to keep it: for example, recording a call may require the consent of the people on it under the law where they are. FilePoppy keeps what you give it and does not review it. Any duty you or your brokerage have to retain transaction communications for a period of years remains yours; FilePoppy helps you meet it but does not take it on.

8. Acceptable use

Use FilePoppy for the real estate transactions you are part of. Do not use it to store material you have no right to, to harass or surveil anyone, to gather other people's conversations without a lawful basis, to probe or overload the service, or to break the law. Do not resell access or share one seat among several people. We may suspend an account that does these things, and we will tell you why.

9. Your data

What we collect, where it lives, and how long we keep it is set out in the Privacy Policy, which is part of these terms. Your transactions belong to you. We do not sell them, advertise with them, or use them for anything but keeping your record and showing it back to you.

10. Changes to the service

PeopleStar may update FilePoppy - add features, change how a screen works, retire a part of it, or raise the minimum version of FilePoppy Capture that the cloud will accept, when an older version would file a record incorrectly. We will tell you about changes that affect how you use it. If we ever discontinue FilePoppy, we will tell you in advance and give you a way to download everything in your account.

11. Warranties and liability

We work hard to keep FilePoppy accurate and available, and we build in checks - such as reconciling every message in the database against every message in the log - to catch our own mistakes. Even so, FilePoppy is provided as it is, without a warranty that it will be uninterrupted or error-free. To the extent the law allows, PeopleStar is not liable for indirect or consequential loss, and our total liability to you for anything arising from FilePoppy is limited to what you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

12. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute that cannot be settled by talking to us first will be brought in the state or federal courts located in California.

13. Changes to these terms

If we change these terms in a way that matters, we will say so at the top with a new effective date, and tell you in the app or by email before the change takes effect. Continuing to use FilePoppy after that is acceptance of the new terms.
